1. Acceptance of these Terms
These Terms and Conditions (“Terms”) are a binding agreement between you and the operator of MaxRep (“MaxRep,” “we,” “us,” or “our”). They apply to the MaxRep mobile application, website, public workout and profile pages, club and group experiences, and any related services that link to these Terms (collectively, the “Service”).
By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you use MaxRep for a club, gym, employer, team, or other organization, you confirm that you have authority to accept these Terms for that organization where applicable.
2. Eligibility
You must be at least 13 years old to use MaxRep. If the age of legal majority where you live is higher than 13, a parent or legal guardian must review and agree to these Terms on your behalf. MaxRep is not directed to children under 13, and they may not create accounts or submit personal information.
You may use the Service only if applicable law permits you to do so and you have not previously been suspended for serious or repeated violations.
3. Your account and security
You agree to provide accurate information, keep it current, and protect your login credentials, verification codes, and devices. You are responsible for activity under your account except to the extent caused by MaxRep. Tell us promptly through in-app support or at hello@maxrep.me if you believe your account or phone number has been compromised.
If you sign in or verify an action with a one-time password sent by text message, you must control or be authorized to use the phone number you provide. Never share an authentication code. Additional terms are in our SMS & One-Time Password Terms.
4. The MaxRep Service
Depending on your version, account, and location, MaxRep may let you:
- record workouts, exercises, sets, repetitions, weight, duration, training volume, calories, distance, routes, streaks, and personal records;
- log foods and nutrition through manual entry, photographs, voice input, or barcode scanning and review estimated calories and macronutrients;
- maintain a profile, follow other members, share workouts, react, comment, compare progress, and participate in leaderboards;
- create or join groups, clubs, training sessions, challenges, and events; and
- publish or share selected profiles and workouts through public web pages or links.
Features may differ by platform, be released gradually, change, or be discontinued. We do not guarantee that every feature, exercise, food, metric, integration, club, or member will always be available.
5. Health, fitness, and safety
MaxRep is a tracking and social fitness tool, not a medical service. It does not provide medical diagnosis, treatment, emergency assistance, physical therapy, or individualized professional advice.
Exercise, dieting, supplements, cold exposure, heat exposure, and other fitness activities carry risks that may include serious injury, illness, or death. You are responsible for choosing activities appropriate for your health, experience, equipment, and surroundings, using proper form and safety equipment, and stopping if you feel pain, dizziness, shortness of breath, or other concerning symptoms.
Consult a qualified physician, registered dietitian, trainer, or other appropriate professional before beginning or changing a fitness or nutrition program, particularly if you are pregnant, injured, taking medication, have a medical condition, have a history of disordered eating, or have concerns about calories or nutrition tracking. For an emergency, call local emergency services; do not rely on MaxRep.
Information shared by other users, coaches, clubs, or administrators is their own and is not verified or endorsed by MaxRep.
6. Metrics, estimates, and AI-assisted features
Workout volume, calories burned, calories consumed, macronutrients, streaks, personal records, route distance, rankings, and similar outputs may be estimated from information you or others provide. Photo, voice, barcode, and AI-assisted nutrition features can misidentify a food, serving size, ingredient, or quantity. Device sensors, food databases, maps, and third-party services can also be incomplete or inaccurate.
Review outputs before relying on them. These outputs are informational and motivational only and should not be used to make medical, medication, allergy, eating-disorder, or other high-stakes decisions. Leaderboards and achievements are designed for friendly motivation and are not official athletic results.
7. Community, visibility, and public sharing
MaxRep includes social features. Information you place on a public profile, public workout page, feed, leaderboard, event, or public share link may be visible to anyone, indexed by search engines, reshared, or captured by others. Group or club content may be visible to members, organizers, coaches, or administrators according to that space’s settings.
Review the audience and privacy setting before posting. Do not post a precise route, location, health detail, photograph, or other sensitive information unless you are comfortable with the selected audience receiving it. Removing content from MaxRep may not remove copies previously saved or shared by others.
8. Your content
“User Content” includes profile information, photos, voice inputs, workout and nutrition logs, routes, comments, posts, messages, club materials, and other material you submit. You retain ownership of your User Content.
You grant MaxRep a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt for technical display, transmit, and display User Content only as needed to operate, secure, improve, and provide the Service and according to your settings. This license ends when the content is deleted from our active systems, subject to reasonable backup, legal, safety, and fraud-prevention retention.
You confirm that you have the rights and permissions needed to submit User Content and select its audience. If your content includes another person, you are responsible for obtaining any consent required to collect, upload, or share it.
9. Acceptable use
You may not use the Service to:
- harass, threaten, exploit, impersonate, stalk, or endanger another person;
- post unlawful, hateful, sexually exploitative, deceptive, infringing, or malicious content;
- publish another person’s private health, location, contact, or account information without authorization;
- promote dangerous training, self-harm, disordered eating, illegal substances, or fraudulent products;
- cheat, manipulate rankings, fabricate records, abuse referral systems, or automate activity without permission;
- probe, disrupt, overload, reverse engineer, scrape, or bypass access, privacy, rate, or security controls except where law expressly permits;
- upload malware or use MaxRep to send spam or unauthorized commercial messages; or
- use outputs or data to make decisions about another person’s employment, insurance, credit, housing, or eligibility.
We may moderate or remove content and restrict features when reasonably necessary to enforce these Terms, protect members, or comply with law.
10. Clubs, groups, coaches, and events
Club and group organizers may manage members, workouts, schedules, unlock codes, events, and shared displays. They are responsible for their instructions, events, facilities, equipment, staffing, permissions, and compliance with applicable law. MaxRep does not supervise or assume responsibility for in-person activities or relationships between members and organizers.
Joining a private group or using a club code does not make all content confidential. Ask the organizer how data is used, and use judgment before sharing. A club’s separate terms or privacy practices may also apply when it independently collects or uses your information.
11. SMS, email, and notifications
We may send essential service communications, including account, security, verification, moderation, and transactional notices. Marketing communications, if offered, require any separate consent required by law and can be turned off independently from security messages.
SMS verification is governed by our SMS & One-Time Password Terms. Standard message and data rates may apply. You can manage non-essential push or email notifications in your device, account, or message settings.
12. Paid features and app stores
If MaxRep offers subscriptions, purchases, or paid services, the price, renewal period, billing terms, and cancellation method will be shown before purchase. App-store purchases are also governed by the applicable store’s terms and billing rules. Except where law requires otherwise, fees already paid are non-refundable. Paid features may be subject to additional terms presented at purchase.
13. Third-party services
The Service may rely on or link to app stores, device platforms, maps, food and barcode databases, messaging providers, hosting providers, clubs, or other third parties. Their services and content are governed by their own terms and privacy policies. MaxRep is not responsible for third-party services that it does not control.
14. MaxRep intellectual property
The Service—including its software, design, brand, logos, graphics, and non-user content—is owned by MaxRep or its licensors and protected by law. Subject to these Terms, MaxRep gives you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose.
If you provide feedback or suggestions, you allow us to use them without restriction or compensation, but you do not transfer ownership of your existing intellectual property.
15. Suspension, termination, and deletion
You may stop using MaxRep at any time and may request account deletion using available account controls or by contacting us. We may suspend or terminate access when we reasonably believe you materially or repeatedly violated these Terms, created risk or harm, or when required by law. Where appropriate, we will provide notice and an opportunity to appeal.
Provisions that by their nature should survive termination—including ownership, disclaimers, liability limits, and dispute provisions—will remain in effect.
16. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” MaxRep disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage. We do not warrant that the Service or any metric, recommendation, database entry, content, message, synchronization, or integration will be accurate, complete, secure, uninterrupted, or error-free.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
17. Limitation of liability
To the maximum extent permitted by law, MaxRep and its affiliates, personnel, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or opportunity, arising from the Service—even if advised that such damages are possible.
To the maximum extent permitted by law, MaxRep’s total liability for claims relating to the Service will not exceed the greater of (a) the amount you paid MaxRep for the Service during the 12 months before the event giving rise to the claim or (b) US $100.
These limitations do not apply where prohibited by law or to liability that cannot lawfully be limited, including certain liability for fraud, intentional misconduct, or personal injury.
18. Disputes and applicable law
Before filing a formal claim, you and MaxRep agree to try in good faith to resolve the issue informally for 30 days after written notice, unless urgent relief is necessary. Send a notice to hello@maxrep.me with “Legal Notice” in the subject line and enough information to evaluate the issue.
These Terms are governed by the laws that apply to the MaxRep operator identified in the applicable app listing or purchase record, without regard to conflict-of-laws rules, while preserving mandatory consumer protections in your place of residence. Any court proceeding must be brought in a court with lawful jurisdiction over the dispute. Nothing here prevents either party from seeking eligible relief in small-claims court or making a complaint to a regulator.
19. Changes to these Terms or the Service
We may update these Terms to reflect feature, legal, safety, or business changes. We will post the updated version and revise the “Last updated” date. If a change materially affects your rights, we will provide additional notice when required. Continued use after the effective date means you accept the updated Terms; if you do not agree, stop using the Service.
